Minority schools can hire non-minority faculty: HC

Chennai: Aided minority institutions are well within their rights to admit non-minority students or appoint non-minority teachers,the Madras High Court has said,adding that such a secular gesture should be welcomed.
Justice K Chandru,dismissing a writ petition filed by a Christian candidate who sought the cancellation of the appointment of another person who had furnished a fake Christian certificate,said: Even in respect of Christian minority school,since the right to manage the school vests with the management,it is open to them to appoint any candidate who has the necessary qualifications.The Supreme Court has held that if a minority institution acts like a secular institution,that can be welcomed.There is no bar on a minority institution from admitting non-minority students or appointing teachers belonging to other religions.
In her petition,W Queen Sheeba contended that P Pravin was appointed physical education teacher at Concordia Higher Secondary School in Ambur,on the basis of a fake Christian certificate furnished by him.Stating that Pravin was a Hindu,Sheeba wanted the court to quash his appointment in the Christian school.
Sheeba alleged that members of the Ambur Synod had taken money from Pravin and appointed him teacher in the school,and that despite representations to the authorities no action had been taken against them.Justice Chandru,rejecting the submissions,said: The claim of Sheeba that only because she is a Christian she must get preference over another person cannot be accepted.
Being a Christian minority institution,the school enjoys certain autonomy as guaranteed under Article 30(1) of the Constitution,he said,adding that so long as the appointment was in consistence with the provisions of the Tamil Nadu Recognised Private Schools (Regulation) Act and Rules,no exception can be taken.Pointing out that Sheeba herself had not alleged any violation of rules concerning the mandatory qualifications of Pravin,the issue cannot be ordered in her favour,Justice Chandru said,adding that she could raise such issues before the church authorities and not before the high court.
